What is Extended Producer Responsibility?

Extended Producer Responsibility (EPR) is an environmental policy principle that holds producers responsible for the end-of-life management of the products and packaging they place on the market. Understanding EPR is essential for any EU or non-EU company selling into European markets.

What is an Authorised Representative?
EU and non-EU producers are required to appoint a locally established Authorised Representative who takes on all EPR obligations on their behalf — registration, reporting, legislation monitoring — under the national legislation of each EU member state.

Slovak law (Zákon č. 79/2015 Z. z. o odpadoch):
Under § 27 of the Slovak Waste Act, a producer of reserved packaging who is not established in Slovakia is obliged to appoint an Authorised Representative established in the Slovak Republic. The Authorised Representative acts in the name and on behalf of the producer, fulfils all obligations arising from the Act, and is jointly and severally liable with the producer for compliance with these obligations.

Czech law (Zákon č. 477/2001 Sb. o obalech / Zákon č. 542/2020 Sb. o výrobcích s ukončenou životností):
Under Czech packaging and waste legislation, a producer or importer of packaging, WEEE and batteries, which is not established in the Czech Republic must appoint a Czech-registered Authorised Representative (zmocněný zástupce) to fulfil producer registration, take-back scheme participation, and reporting obligations to the Czech Environmental Inspectorate on their behalf.
Who needs EPR compliance?
Any producer, importer or online seller placing regulated products — packaging, electrical equipment, batteries, tyres or vehicles — on EU markets must register and fulfil EPR obligations in each country of sale.
What categories are regulated?
Regulated product categories in Slovakia, Czechia and Poland include: packaging and packaging waste, non-packaging, WEEE (electrical and electronic equipment), batteries and accumulators, tyres, oils and end-of-life vehicles.
What are the consequences of non-compliance?
Non-compliance with EPR regulations can result in significant financial penalties, product seizure, and loss of market access in the respective country. Proactive compliance is far more cost-effective than reactive enforcement response.
